Q: Previously, he divorced his wife with a revocable divorce, then he took her back based on a fatwa from the Department of Ifta, and then he divorced her afterwards by saying to her: "You are divorced, divorced, divorced," and he intends the second and third repetitions to be an emphasis of the first, and that he did not intend a number. He asks whether he has the right to take her back given the situation described?
A: We reviewed the fatwa mentioned by the questioner in his inquiry and found that it was issued by the Department of Ifta on the date 1384 AH, and that it states that his divorce was considered a single pronouncement. Since the inquirer mentioned that he divorced his wife afterwards by saying to her: "You are divorced, divorced, divorced," and that he intends the repetition to be merely an emphasis, not that he intends a number, his divorce is considered a single pronouncement. If this divorce was not the third of three pronouncements issued by him, then
he has the right to take his wife back if she is still in the waiting period. However, if she exits the waiting period before he takes her back, it is permissible for him to marry her with a new contract and a new mahr with her consent, and she remains with him with one pronouncement. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
