Fatwa No. ( 1976 )
Q: On Sunday, corresponding to 2/5/1398 AH, a quarrel occurred between me and my wife, named (F. Ali), until my anger reached the point where I divorced her twice, and I took her back immediately. The questioner was asked about the nature of the divorce, and he said: I said: (You are divorced, you are divorced) and my intention was to confirm the first one, and no divorce occurred from me other than that, neither before nor after, and there was no compensation. I wish to take back my wife, and I want a fatwa from your eminence.
A: If the situation is as you described, that you said: You are divorced, you are divorced, and you took her back before she exited the waiting period, and this divorce was not preceded by a divorce, nor followed by a divorce, then your taking her back is valid, and only one divorce takes effect on her, and you have two remaining divorces for her after this taking back. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his companions.
