O Beloved: Your noble letter dated 17/7/1390 AH, which is a response to my letter number 1224, dated 9/7/1390 AH, has reached you, may Allah guide you. I understood what your virtue recorded regarding the nature of the divorce that occurred from: I. K. H. to his wife, which is that he said to her in a state of anger: “You are forbidden. Divorced. Divorced. Divorced,” and he had not divorced her before that.
This is after you heard the statements of the aforementioned man, his divorced wife, and his son from him, who is twenty years old, and her brother who was her guardian before her son reached maturity; and because the aforementioned husband admitted to me—as recorded in my attached letter number 1224, dated 9/7/1390 AH—that he did not intend the three divorces or any other number, and that he had not divorced her before that.
Answer: Based on that, I issued a fatwa to the aforementioned husband that one divorce has taken effect on the aforementioned wife through the divorce mentioned, and the second and third utterances are considered confirmations of the first utterance. He may take her back as long as she is in the waiting period. If she has exited the waiting period, she is not lawful to him except through a new marriage, with its conditions considered valid by the Shari'ah.
And upon him is the expiation for zihar for his forbidding her—and its order is not hidden from your virtue—and he must not approach her until he performs the aforementioned expiation.
So I hope you will inform everyone of this. May Allah reward you, and thank you for your effort, and may He reward you with good for everyone.
