O Beloved, your noble letter dated 17/7/1390 AH, which is a response to my letter number (1224) dated 9/7/1390 AH, has been received. May Allah guide you. I understood what your virtue noted regarding the nature of the divorce that occurred from the husband A. K. to his wife, namely that he said to her in a state of anger: “You are forbidden, divorced, divorced, divorced,” and he had not divorced her before that. This was after you heard the statements of the aforementioned husband, his ex-wife, and his son from her, A., who is twenty years old, and her brother A. A., who was her guardian before her son A. reached maturity. And because the aforementioned husband admitted to me, as recorded in my attached letter number (1224) dated 9/7/1390 AH, that he did not intend the three divorces or any other number, and that he had not divorced her before that.
Answer: Based on this, I issued a ruling to the aforementioned husband that one divorce has taken effect on the aforementioned wife through the divorce mentioned above. The second and third utterances are considered confirmations of the first utterance. He has the right to take her back as long as she is in the waiting period. If she has exited the waiting period, she is not lawful to him except through a new marriage with its conditions that are valid in the Shari'ah. Upon him is the expiation for zihar for his forbidding her, and the arrangement of this is not hidden from your virtue. He must not approach her until he performs the aforementioned expiation.
