Q: A misunderstanding occurred between him and his wife, and as a result, he said to her: “Divorced, then divorced, then divorced.” He states that his intention in repeating it was only to make her hear it, and that he did not intend the number. He asks: Is it permissible for him to take her back?
A: If the matter is as the questioner stated, that he said to his wife: “Divorced, then divorced, then divorced,” then the school of thought and the position of the fatwa is that his wife is divorced from him with a major final divorce, and she is not lawful for him until she marries another husband, a marriage of desire, not a marriage of reconciliation. What the questioner stated about his intention in the repetition being to make her hear it, and not to intend the number, is rejected because the description of the repeated divorce came in a sequential manner that does not allow for emphasis. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
