The seventh question of the fatwa number ( 4225 )
Q 7:A married woman committed unlawful sexual intercourse while she was under the protection of her husband, and then she became pregnant and gave birth to a child, whether male or female. With whom should that child remain?Should he remain with his husband, based on the evidence of the hadith:
The child is for the bed (i.e., belongs to the husband) and the fornicator gets nothing!الولد للفراش وللعاهر الحجر
Sunan Ibn Majah 2006Sahih (Darussalam)

Or not? And if he remains with his mother's lawful husband, does he adopt him and count him as one of his children in all rights, or does he have him only as his property? And if he is attributed to the fornicator, does he count him among his real children, or does he keep him with them while he remains in the state of a child of zina?

A 7: If a married woman commits zina and becomes pregnant, the child belongs to the bed; based on the authentic hadith. And if the owner of the bed wants to disown him through li'an, he has that right before the Shari'ah court. And he does not become the slave of anyone by the consensus of the Muslims. As for adoption, it is not permissible, and the adopted child does not become the child of the one who adopted him. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
