Q: I have an elderly mother who is about sixty-five years old or more. My father passed away, and she did not observe the mourning period for him. She married a second man without observing the mourning period. We ask for your guidance on this matter and what we should do. We seek your direction and guidance in this specific case, knowing that my mother is still alive and that she is remorseful for what happened, as this occurred a long time ago when they were with the Bedouin and were ignorant of the ruling. We ask your Eminence to guide us to the truth and tell us what to do. May Allah reward you with the best reward and keep your steps steady.
A: If your mother married after the completion of the waiting period of four months and ten days, or after she gave birth if she was pregnant, then her marriage is valid even if she did not observe the mourning period. However, if she intentionally left off the mourning period during the waiting period,
knowing the ruling, then she has sinned by doing so, and she must repent to Allah for it. If she was ignorant, then she has not sinned. As for if she married before the completion of the waiting period, then her marriage is invalid, and you must refer to the court to verify this. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
