Fatwa No. ( 4728 )
Q: I wish to marry my eldest maternal uncle's daughter, who is approximately the same age as my mother. Breastfeeding occurred between my older brothers and my maternal uncles, who are approximately the same age as them, from my mother and my grandmother. As for me, I was not breastfed by anyone other than my mother and my maternal uncle's daughter, nor was she breastfed by anyone other than her mother. They say that I have become her paternal uncle by virtue of the breastfeeding that occurred between my brothers and my maternal uncles. Am I her paternal uncle, or is she permissible for me to marry?
A1: If the situation is as you described, regarding the breastfeeding of your maternal uncles by your mother and your grandmother along with your older brothers, then if their breastfeeding from your mother or your grandmother was five breastfeedings or more within the two-year period, it is not permissible for you to marry any of your maternal uncles' daughters; because you are their paternal uncle by breastfeeding. And if the breastfeeding was less than that, or if it occurred after the two-year period, it is permissible for you to marry from
the daughters of those whose breastfeeding from them was less than five breastfeedings, or if it occurred after the two-year period. Allah the Exalted said:
Prohibited to you [for marriage] are your mothersحُرِّمَتْ عَلَيْكُمْ أُمَّهَاتُكُمْ
[An-Nisa 4:23]
until He said:
your brother's daughters, your sister's daughtersوَبَنَاتُ الأَخِ وَبَنَاتُ الأُخْتِ
[An-Nisa 4:23]
, and He said:
Mothers may breastfeed their children two complete years for whoever wishes to complete the nursing [period].وَالْوَالِدَاتُ يُرْضِعْنَ أَوْلادَهُنَّ حَوْلَيْنِ كَامِلَيْنِ لِمَنْ أَرَادَ أَنْ يُتِمَّ الرَّضَاعَةَ
[Al-Baqarah 2:233]
, and it is established from the Prophet (peace and blessings be upon him) that he said:
Breast-feeding makes unlawful (for marriages) the same things that blood tie make unlawful.يحرم من الرضـاع ما يحرم من النسب
Sunan Ibn Majah 1937Sahih (Darussalam)
And it is established from A'ishah (may Allah be pleased with her) that she said:
it had been revealed in the Holy Qur'an that ten clear sucklings make the marriage unlawful, then it was abrogated (and substituted) by five sucklings and Allah's Apostle (ﷺ) died and it was before that time (found) in the Holy Qur'an (and recited by the Muslims).كان فيما نزل من القرآن: (عشر رضعـات معلومات يحرمن) ثـم نسخن بـ: (خمس معلومات) فتوفي رسول الله صلى الله عليه وسلم والأمر على ذلك
Sahih Muslim 1452a
, knowing that if a child sucks milk from the breast, even a little, and then leaves it, this is considered one breastfeeding. If he returns to it and sucks milk from it, even a little, and then leaves it, it is considered a second breastfeeding, and so on. As for the maternal uncle's daughter mentioned in the question, she is not forbidden to you; because she was not breastfed by your mother or your grandmother, and you were not breastfed by her mother or her grandmother, as you mentioned in the question.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
