Q: I am a man who is now seventy years old. I was named after my maternal uncle because I lived in his house from my youth, as is the custom of the people of the town, given that my maternal uncle was childless. I know that I did not inherit anything from him, and this name has been established in official documents, so it has been:
(M. R. S. M), and I became known by it among the people, and my children and grandchildren, who number approximately fifty individuals now, are named by it. My real name is: (M. 'A. M. M). Recently, I heard the hadith of the Prophet (peace and blessings be upon him) regarding the prohibition of claiming lineage to other than one's father, and I fear that the sin of that will befall me. The questions are: 1- Does the hadith apply to my situation? 2- Will I be sinful if I am unable to do so because of the difficulty of procedures in our courts? 3- Is it permissible, when correcting the name, to add (Al-Rabi'ah) to the real name, as a reference to the house in which I grew up and by which I am known?

A: It is obligatory for you to change your name to the correct lineage; for what is established from Abu Dharr (may Allah be pleased with him), from the Prophet (peace and blessings be upon him), that he said:
If somebody claims to be the son of any other than his real father knowingly, he but disbelieves in Allahليس من رجل ادعى لغير أبيه وهو يعلمه إلا كفر

Narrated by Ahmad and al-Bukhari and Muslim . And what came from Sa'd and Abu Bakrah that the Prophet (peace and blessings be upon him) said:
If somebody claims to be the son of somebody other than his father knowingly, he will be denied Paradise (i.e. he will not enter Paradise).من ادعى إلى غير أبيه وهو يعلم فالجنة عليه حرام

Narrated by Ahmad and al-Bukhari and Muslim and Abu Dawud and Ibn Majah . And among them is what came from Anas that the Prophet (peace and blessings be upon him) said:
If anyone pretends to be the son of a man other than his father, or attributes his freedom to people other than those who set him free, on him will be the curse of Allah that will continue till the day of resurrection.من ادعى إلى غير أبيه أو انتمى إلى غير مواليه فعليه لعنة الله المتتابعة إلى يوم القيامة

Narrated by Abu Dawud . These hadiths, although their wordings differ, all return to the warning of one who claims lineage to a father other than his own father, of being deprived of Paradise and deserving the punishment of the Fire, for changing his lineage and mixing it in lineages. This leads to much corruption, including depriving an heir, inheriting to one who is not an heir, forbidding permissible spouses, and permitting forbidden spouses, and disparaging his lineage and the roots from which he is born, and undutifulness to them... and other corruptions and bad effects. For this reason, he deserved the continuous curse of Allah on the tongue of His Messenger (peace and blessings be upon him). And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
