Q: What is required of me in a case like this? It happened that two people were sleeping next to each other; I refer to the first as (A) and the second as (M), and both are Muslims. What happened is that (M) accused (A) of having taken (A's) hand (i.e., his hand) and placed it on (A's) genitals. A quarrel broke out between them, and one of their relatives intervened, who was perhaps the only one present or the only one who knew what happened, and he was near them at the time. He settled the quarrel and came to me to arbitrate between them regarding what happened, because they would quarrel again, expose themselves, and the problem would develop into something more. So I brought the two of them after the
'Isha' prayer, and they were among the worshippers. I moved aside and seated them in front of me along with their relative who reported the incident to me. I made (M) swear four oaths that he was truthful in his accusation of (A), and before the fifth, I reminded him and warned him of the curse of Allah upon him if he were among the liars. So he swore, stood up, and (A) took his place and swore four oaths that (M) was a liar, and that the anger of Allah be upon him if (M) was truthful. I also reminded him before that, so he swore to that. Then he stood up, and I ordered them not to sleep next to each other again in any place, even if they were forced to do so, and to forget what happened, and to keep the matter secret so that no problems arise if each one's relative learns what happened, and to repent to Allah, and to seek His forgiveness, so that perhaps He will accept their repentance. I did this by analogy to li'an, as it came in the Noble Qur'an, and as is clear in the message. Was I correct in what I did?

A: You were not correct in performing li'an between the two mentioned individuals, but you were correct in what you advised them regarding repentance, seeking forgiveness, and keeping their matter secret. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
