Q: I have a wife named (Q.S.M.H) and I have daughters from her. She left my house against my will. I searched for her and found her at the house of one of my relatives. After that, I became very angry with her and said to myself: “She is like my mother to me.” I was angry because of her leaving my house. Now she is with her guardian, and he refused to let her return unless there is a fatwa. Therefore, I ask Allah, then you, for a fatwa on this matter. May Allah preserve you.
A: If you uttered the words: “She is like your mother to you,” then the ruling on that is zihar. You must expiate for the zihar, and you must not touch her until you have expiated. The expiation is: freeing a believing slave. If you do not find one, then fast for two consecutive months. If you are unable to do that, then feed sixty poor people, giving each poor person half a sa' of wheat, dates, rice, or the like of the local staple food.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
