Q: A quarrel occurred between my father and my eldest brother, and my eldest brother said the following: “My wife is forbidden to me, like my mother.” This was said in a state of anger. My brother has contracted the marriage with this wife but has not consummated it, and the wedding has not yet taken place. I ask for your fatwa.
A: If what is mentioned regarding your brother forbidding his wife to himself is true, and if this occurred after he had contracted the marriage with her, then he has committed a sin and committed a major sin, and he owes the expiation for zihar. He must separate from her before he touches his wife, whether the forbidding occurred before or after consummation. The expiation for zihar is freeing a believing slave. If he does not find one, then fasting for two consecutive months. If he is unable to do so, then feeding sixty poor people, thirty sa' of wheat, half a sa' for each poor person. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
