Q: I have been married for three years, during which I committed a grave error and a major sin when I had intercourse with my wife from the rear. However, Allah granted me the grace of regretting what happened, and in an attempt not to repeat it, I said: “If I return to her from the rear again, she is forbidden to me,” and I did not inform her of what I had sworn. After approximately two years or more of complete adherence, it happened that she was in her menstrual period, and I was in a state of intense excitement. At that time, I was weak against my self and did not have the strength to resist that desire, knowing that I had sworn not to return to it. So I asked her permission for it, and she agreed solely to please me, and I had intercourse with her from the rear again. Therefore, I seek your ruling on this matter, as I love her, have a daughter from her, and have been living in terrible anxiety and fear since that wretched act, and I have not told her anything.
A: First: Having intercourse with your wife from the rear is one of the major sins, so you must repent and seek forgiveness for what occurred from you, regret the past, and resolve not to return to it. This is not considered a divorce. Second: Your statement: “If I return to having intercourse with her from the rear, she is forbidden to me.” If you intended by this to divorce your wife, then your wife is divorced with one divorce
by your having intercourse with her from the rear the second time, and you may take her back as long as she is in the waiting period, unless there were two previous divorces. If you intended by forbidding her to prevent yourself from having intercourse with her from the rear, not to divorce her, then it is obligatory for you to pay the expiation for an oath by returning to having intercourse with her from the rear the second time. The expiation is: feeding ten poor people, or clothing them, or freeing a believing slave. If you cannot do so, then fast for three days. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
