Q: A discussion took place between me and my wife, in which she spoke to me in a way that shook my feelings, which angered me and stirred up anger in me. During this time, I said the word: "Cover yourself." She has four children from me. Does my statement count as a divorce between us? Knowing that I retracted this statement at the time in the presence of two witnesses.
A: If the matter is as you described, and the anger that occurred when you said to your wife: "Cover yourself" was such that you did not know what you were saying, and you have proof of that, then your saying: "Cover yourself" does not result in a divorce. However, if you knew what you were saying, then your saying: "Cover yourself" is an indirect expression of divorce, and one divorce takes place with it; due to the presence of a circumstance indicating the intention to divorce, which is the occurrence of a discussion between you and her to the extent that you became angry with her. If this
divorce is not the third of three, and since you mentioned that you took her back at the same time the divorce occurred; if this is the reality, then your taking her back is valid, and the wife remains in your possession with what remains of the divorces. If this divorce was the third of three, she is not lawful to you again except after another husband. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
