Q 2: We have certain customs: when a fight occurs between one person and another, resulting in bloodshed or death and thus in blood money, the tribe pays the amount resulting from the fights to the tribe to which the blood or the blood money belongs. The tribe also takes the amount if the blood money or blood is in our favor and divides it equally among the members of the tribe . Is this process merely cooperation and agreement among the members of the tribe?
A 2: The blood money belongs to the victim if it is for a limb, or to the heirs of the murdered person according to their inheritance shares by fixed shares and residuary rights. If they wish, they may take it, and if they wish, they may forgive it. No one other than the heirs has any right to it, and customs that contradict
the Shari'ah must be abandoned; because they are from the ruling of the pre-Islamic age of ignorance. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
