She killed her fetus twice intentionally

Fatwa No. ( 21823 )
Q: I am a woman who was in ignorance and married at a young age in an area cut off from mosques, scholars, and preachers. Allah knows that I
was ignorant of my affairs, and I committed major sins and transgressions; such as theft, causing fitnah, and talebearing among Muslim women. And among the greatest of these sins is the crime of zina. She became pregnant by her husband, and it was her first pregnancy, reaching four or five months. She killed it out of ignorance, knowing that she did not realize that this act is a great sin, and she killed it so that it would not occupy her with her adornment and her work, knowing that her father did not know about this matter. Then she became pregnant with another child, and when it reached eight months in her womb, she intentionally carried some heavy weights to destroy this fetus in her womb. When she gave birth, it came dead after living for about 5 hours, then it died on the same day. As for prayer, she does not pray except only in Ramadan, and her prayer may not be accepted from her. As for fasting, she used to fast out of showing off and seeking reputation, not fasting for the face of Allah. Then she gave birth to her husband children and daughters, then she became pregnant with another daughter, and the woman suffered from a severe illness. Then she was treated in some health centers, and this daughter came out dead, knowing that she did not know whether it was due to the treatment or not, and she did not cause her death. She was in problems with her husband and did not fulfill the husband's lawful rights, and likewise the husband did not fulfill her rights. And when she remembers these sins, she becomes ill and tired. And these things were about 40 years ago or more. Then she returned to Allah with sincere repentance about 5 years ago. And now she
is upright, praise be to Allah, she prays and cries night and day over these things, and she regrets all these bad actions, knowing that she stands in night prayer and prays in it in addition to other voluntary prayers. Note: If the kaffarah is fasting, she cannot do continuous fasting due to illness and her advanced age, so what is obligatory upon her regarding the mentioned things? And may Allah reward you with good.

A: First : This woman must repent to Allah from the sins that occurred from her, and Allah accepts the repentance of whoever repents:
And it is He who accepts repentance from his servants and pardons misdeedsوَهُوَ الَّذِي يَقْبَلُ التَّوْبَةَ عَنْ عِبَادِهِ وَيَعْفُو عَنِ السَّيِّئَاتِ
[Ash-Shuraa 42:25]
. Second : She owes the diyah for her son whom she killed intentionally and oppressively after he was born at five months, and the diyah belongs to his heirs, and she has nothing of it. Third : She owes the diyah for the fetus whom she killed in her womb, which had reached eight months, and its diyah is one-tenth of its mother's diyah, belonging to its heirs and not to her. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
