All praise is due to Allah alone, and peace and blessings be upon the one after whom there is no prophet. Having reviewed the matter submitted to His Eminence the Grand Mufti by the questioner: the acting religious supervisor at King Khalid Hospital for the National Guard in Jeddah, and Dr. \ Naif al-Suhayli , consultant in gynecology and obstetrics, and referred to the Committee by the General Secretariat of the Council of Senior Scholars with number (642) and date 29 \ 1 \ 1417 AH, the questioner asked the following: Is it permissible to terminate (abort) the pregnancy of a deformed fetus whose death is certain after birth ? The deformities are numerous and affect parts of the body as follows: 1 - Deformity in the heart. 2 - Serious deformity in the spinal cord and spine. 3 - The head is very small. 4 - Between the head and the body, there is a large sac bigger than the head.
5 - The intestines are outside the abdominal cavity. 6 - Deformity in the brain. It is known that the woman is in her fifth month of pregnancy, her mental state is very poor, and she is exhausted by the condition of her fetus. She agrees to its termination, and her husband does as well. Given all this, is it permissible for the doctors to terminate the pregnancy? If it is not permissible, what is the ruling on the one who does it, and what is required of him? Please issue a ruling, may Allah reward you.

After studying the question, the Committee responded that it is not permissible to terminate the aforementioned pregnancy; because the general opinion of doctors is based on conjecture, and the original ruling is the obligation to respect the fetus and the prohibition of aborting it; and because Allah (Glorified and Exalted is He) may improve the condition of the fetus during the remaining period, so that it is born free from what the doctors mentioned, if what they said is true. Therefore, it is obligatory to have good opinion of Allah, and to ask Him (Glorified and Exalted is He) to heal it, to complete its creation, and to bring it out healthy. And its parents should fear Allah (Glorified and Exalted is He) and ask Him to heal it from all evil, and to make their eyes content by giving birth to it healthy. And the Prophet (peace and blessings be upon him) said:
Allah Almighty said, "I am according to My slave's opinion of Meيقول الله عز وجل: أنا عند ظن عبدي بي
