Q: Two brothers, the elder named Shar'ah ibn Muhammad and the younger named Nasser ibn Muhammad. Shar'ah died, leaving behind three daughters and a son. Nasser married his brother Shar'ah's wife, and she bore him two sons and two daughters. Nasser also has children from another wife, besides his children from his brother's wife. Is it permissible for Nasser's children, who are from a wife other than his brother's wife, to marry their cousin, the daughters of Shar'ah ibn Muhammad, or not?
A: It is permissible for the children of Nasser ibn Muhammad to marry the daughters of their cousin Shar'ah ibn Muhammad, who were born to their cousin Shar'ah from a woman other than their father's wife. Their father's marriage to their cousin Shar'ah's wife is not a barrier to this marriage, as long as there is no other factor besides that which prevents it, such as milk kinship or the like. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
