Q: Indeeda verbal dispute and anger arose between me and my wife, and I said to her: "You are divorced," but I did not actually intend divorce; it was merely the effect of anger. She replied to me: "I will not leave the children. If you want to leave, then leave."The two of us remained with the children in our house, and since that time I have been carrying feelings in my heart; therefore, I ask for your guidance, may Allah reward you.
A: If the situation is as you described, what occurred on your part is considered one divorce. Then, if it was not the third of three divorces, you may take her back with the testimony of two just witnesses as long as she is in her waiting period. The waiting period for a menstruating woman is three menstrual cycles, for a pregnant woman until she gives birth, and for a non-pregnant woman who has stopped menstruating, it is three months. However, if this divorce of yours was the last
of the three divorces, she is not lawful to you until she marries another husband, and he has intercourse with her and then divorces her, or he dies, and her waiting period is completed, after which she becomes lawful to you with a new marriage contract and a new bridal gift, with her consent. You have done wrong by staying with her in this situation, because she is divorced from you with finality. So seek forgiveness from Allah and turn to Him in repentance, and do not return to such a thing; so that you may be clear about the matters of your religion. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
