Q: I present this matter to your Eminence, asking Allah to guide us all to what pleases Him. We inform your Eminence that a cousin of my daughter has proposed marriage to her, and he fully meets the conditions for marriage, as he is known among his peers and the extended family for his scrupulousness and mindfulness of Allah. His education is at the university level, and he has the ability to provide for his wife at a satisfactory level. My daughter has agreed to the marriage, accepting his religion, character, and social standing. I have also agreed to it, and the groom's family agrees as well. There was no objection from my sons and daughters, except that the objection came only from her mother, on a weak pretext, which is as follows:
1 - The news of this cousin's desire to marry my daughter spread without our knowledge. 2 - The reputation of the groom's father (my cousin's son) was not good at one time. I tried to convince her by all means for a full year, and I delayed finalizing the marriage procedures for a full year, hoping she would change her mind, but she persisted further. This forced me to make the decision to end the marriage procedures for fear that she would miss the age for marriage, as she graduated from university two years ago. When I decided that, her brothers and sisters changed their minds and stood with their mother opposing the marriage, on the pretext that obedience to the mother is more important than obedience to the father, relying on the hadith of the Messenger of Allah (peace and blessings be upon him) regarding who among people is most deserving of good companionship. I tried much with them, but they were adamant that the marriage not take place. When I set the date for the marriage contract, they resorted to boycotting, had it not been for the intervention of some mediators. Since I have daughters of marriageable age as well as sons, and so that what happened does not recur, we ask your Eminence to graciously issue a written fatwa to us on the following: 1 - In the case where the daughter agrees to marry a groom who meets all the conditions of a husband, and the father agrees, is it necessary for the wife and the sons to agree, and are they obligated to obey the father and agree with him in completing
the marriage? 2 - What is the validity of the sons standing with their mother, citing the hadith mentioned?
A: If a suitor proposes to a girl and she and her guardian are pleased with him, then no other relatives of hers have the right to object to marrying her to him; because they have no guardianship over her; and because of his saying (peace and blessings be upon him):Sunan Ibn Majah 1967Da'if (Darussalam) narrated by Ibn Majah and al-Tirmidhi , and the address is to the guardians and not to others. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
