Annulment of the Engagement

Machine translationRead the Arabic original
Fatwa No. ( 13875 )
Q: I came to Saudi Arabia from Egypt with a sister of mine who is contracted as a teacher in Saudi Arabia, and her contract will end this year due to her circumstances. She is not married and does not wish to return. I have not been able to find work since I arrived, because we are in the customs area between Kuwait and Saudi Arabia, which is the ( al-Raqi' ) area, belonging to Hufar al-Batin, and it is an area almost devoid of work due to the halt in activity there after the events in Iraq, and consequently I will return to Egypt if Allah wills, in my current state. The situation is that I graduated from the College of Sharia and Law in Egypt, Al-Azhar University in Asyut, two years ago, in the May 1988 session with a grade of (Good), and I became engaged to a sister from my same country, in the ( Minya ) governorate, for a marriage project and engagement. I have not been able to find work because appointment is
after five years, and the opportunity was in my presence with my sister. After my arrival, given the current reality and the long duration of the engagement without any progress, I am thinking, indeed I have decided, to annul the marriage project and to stop thinking about marriage entirely due to my difficult circumstances. My family is of moderate means, and my sister helped my eldest brother and cannot bear to help me. However, what I am asking you is: Will I bear a sin in annulling the engagement for waiting for the sister for a period of two years, but this is not in my hands? And is there any accountability that falls on my shoulders because of this sister? I ask you to inform me, as I will send to them, because their date is next month, and it is a date between me and her family so that they know my position regarding them, and I cannot deceive them until I descend, because the facilities' opportunity for work is weak. May Allah reward you with good.

A: You bear no sin if you annul the engagement given the circumstances you mentioned. May Allah make your affairs easy. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
