The inability of the mahram to travel with the woman
Machine translationRead the Arabic original
The fourth question of Fatwa No. ( 1559 )
Q4: A man in the Kingdom—for example—wants to bring his wife from her country, but there is no mahram to perform the travel procedures with her and travel with her, and the husband does not have the means to travel there and back. Is it permissible for this necessity to be met by a non-mahram performing her travel procedures and sending her with other non-mahrams to her husband?
A4: One of her mahrams, such as her father or one of her brothers, or any other of her mahrams, can bring this woman to her husband. If that is not possible, then either she should be left with her family, or her husband should travel and bring her when it becomes easy for him to do so. As for her traveling from her country to her husband's country with a non-mahram, that is not permissible for her; due to the generality of the prohibition by the Prophet (peace and blessings be upon him) of a woman traveling with a non-mahram. This is not hidden from the questioner. And among the established principles in the Shari'ah is that averting harm takes precedence over seeking benefit. And Allah (Glorified and Exalted is He) knows best.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
