The tenth question of Fatwa No. ( 9450 )
Q10: A man proposed to a girl, and her father made it a condition, in addition to the mahr, that he pay him a sum of money, and the suitor accepted this. Is what her father took considered haram? Does it fall under the saying of the Messenger of Allah (peace and blessings be upon him):?
A10: The mahr of a woman is her property. What her father stipulated for the husband, and the husband agreed to, is obligatory for the husband to pay to her father. This is based on the hadith established from A'ishah (may Allah be pleased with her), that the Prophet (peace and blessings be upon him) said:Sunan Ibn Majah 2290Sahih (Darussalam) And what
they stipulated of the sum does not fall under the hadith regarding the prohibition of consuming the price of a free person; because her father did not sell her, but rather contracted the marriage for her in the prescribed manner. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
