Q4: What is the ruling on the slaves of these recent centuries who were not taken in a war of jihad? Are they slaves, or is it not valid? Is there zakah on the slave's wealth that he or his master pays? And is zakah given to a monotheist slave if he is poor? Please inform us with an answer that cures the sick and quenches the thirst, and peace be upon you.
A4: First: One who is enslaved in an Islamic war, or one who is born from an enslaved woman in the same way - if he is from other than her master - is a slave whom his owner may sell and employ without wages, and it is permissible for the master of the female slave to have intercourse with her without
a marriage contract and without a bridal gift. Second: One who is owned as a slave, whether male or female, has no zakah on the wealth in his possession; because he and his wealth are the property of his master. Third: Zakah is not given to a slave or a female slave; because they are rich by the wealth of their master. But if they are poor and their master does not provide for them, it is permissible to give them from the zakah. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
