Q: A husband passed away, leaving behind a furnished house with a bedroom and its accessories. Does this bedroom belong exclusively to the wife, or is it shared among the heirs? Also, the wife had lent her husband gold to complete a project. Is its value to be taken from the estate and given to the wife, or not? Furthermore, regarding the transfer of guardianship over the orphans—who reside in Riyadh —while the mother and children are in Oman, and in this case they need expenses to transfer them from Oman to Riyadh, is it permissible to transfer the guardianship over the orphans to Oman to be closer to them? Please issue a ruling, may Allah reward you with good.
A: As for the bedroom and what was specific to the wife, this has no connection to the estate; because this is among the things specific to the wife. And if the loan is established, then it is a debt in the deceased's liability that is paid from the estate like other debts. As for transferring the guardianship over the orphans from Riyadh to Oman , this is within the jurisdiction of the Shari'ah courts. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
