Q: It is customary in our village, (Dramah) Bani Bishr Qahthan al-Janub , that if a man is killed, his blood money is distributed as follows: 1 - One-third to his heirs. 2 - One-third to his relatives. 3 - One-third to the general community in their fund. We ask for your ruling: is this permissible or not?
A: Distributing the blood money as mentioned in the question is not permissible. The Islamic ruling is that it should be distributed to the deceased's heirs along with the rest of his estate, after paying off his debts if he had any, and executing his lawful will if he left one. If the heirs, or some of them, waive a portion of their inheritance in favor of the relatives or the fund after the debts have been paid and the will executed, that is permissible; indeed, it is an act of righteousness and kindness. However, the waiver is only valid if it comes from an adult of sound mind. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
