Q1: I have a full brother who passed away to the mercy of Allah, leaving behind sons and daughters, some of whom are adults and some are minors. Their financial situation is not bad. The deceased had a mosque built of straw which has now collapsed. I wish to rebuild it from the heirs' money so that its benefit returns to the deceased. Is it permissible for me to build it from all of their money? I believe that if the minors were adults, they would not hesitate to build it.
A1: Since the questioner mentioned that he wants to build a mosque that his
brother had previously built of straw, which has collapsed, and he wants to rebuild it from the property of his brother's descendants, some of whom are minors, based on this, it is not permissible to build the mosque from the property of the minors; because they do not possess the valid legal permission to take anything from their money for this project or similar ones. Their guardian is not permitted to dispose of their money except in what is in their interest, and their worldly interest, while they are minors, takes precedence over their hereafter interest. As for the adults, if they give permission, they have the authority to do so on their behalf, and they may donate all of what they inherited from their father to build this mosque, making it for their father or sharing the reward between themselves and him. And you, Jabir Muhammad, since you encourage good and want to donate from the minors' money to build the mosque, spend from the money that Allah has given you on its renovation. And Allah (Exalted and Majestic is He) does not waste the reward of one who does good work. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
