Q: My maternal uncle gave me a sum of money to build a mosque, and then, after a period of about two months, he passed away. I had already started working on the building permits and maps, and with the help of Allah, I completed all the procedures in this regard. After that, some of the heirs, who are three of his sons, demanded that I give them the amount their father gave me and not proceed with building the mosque. What is your opinion, Your Eminence: should I give them this amount, or should I complete the construction of the mosque? Please note that they were aware of this amount before their father’s death. May Allah reward you with good for us and for the Muslims.
A: The amount your maternal uncle gave you to build a mosque, given that he passed away before the mosque was completed, is considered part of the one-third (bequest), unless the heirs who are of sound mind permit it to be taken from their shares, in which case there is no harm in doing so.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
