The Shaykh : Yes, it must be known that money spent on a charitable project is not subject to zakah. Why? Because it has no owner, and one of the conditions for the obligation of zakah is that the money has an owner. Similarly, money that is one-third of a deceased person’s estate bequeathed for charitable works is not subject to zakah, because it has no owner. As for the money this man collected to build the mosque that exceeded what the mosque needed, he should spend it on another mosque according to what public benefit requires.
