The questioner : A woman had a sum of money and intended to use it for building a mosque, but because of its smallness, she wanted to increase it, so she placed it in a shareholding, and her intention was that the entire money be for building that mosque, and she does not want a single riyal from it. Does she owe zakah on that shareholding, given that the original status of that money is that it is for the mosque? And what is your opinion of her action? May Allah guide you?

The Shaykh : Zakah is obligatory for her on this money because this money has not yet transferred out of her ownership. She intended it to be for the mosque, but it has not transferred out of her ownership, so she must pay its zakah. Then I say to her that if she dies, it will not be executed as a bequest because it is still in her ownership, and the dirhams are not held in trust until we say that the dirhams have been endowed. Therefore, we tell her to be careful now to hasten to build the mosque before she dies, and then the heirs will benefit from these dirhams. I see that she should hasten to build the mosque, and she has already taken out the dirhams or intended to take them out for Allah the Exalted. How can she go and earn profit from them? If she says it is small and I want to increase it, we say: use it to build, even if it is only part of a mosque, or add it to the public treasury. The important thing is that I encourage her to hasten now to build the mosque. And Abd al-Rahman the mu'adhdhin says that the time has ended, and with this we conclude this meeting, and until the next meeting, if Allah wills... and peace be upon you and the mercy of Allah and His blessings.
