Q: Ifa man, upon entering his wife’s home after the marriage contract is concluded and the bridal gift is paid, wishes to have intercourse with his wife, she does not allow him access to her body until he gives her a sum that sometimes reaches (15,000) riyals in exchange for breaking her virginity, which is a custom among them that they call: (breaking the seal)End of quote. We ask Your Eminence for a ruling on this custom, which has become a widespread affliction in some tribes, and for advice to those who exaggerate in bridal gifts, so that it may be disseminated to the people of those tribes, because they believe it is permissible and take pride in it.
A: The aforementioned custom, called (breaking the waistband), is a bad custom. It is not permissible to do it or to continue with it, because the husband’s right to enjoy his wife’s private parts is established by the contract and the payment of the mahr (bridal gift) according to the Shari'ah. Therefore, the woman’s refusal to her husband until he pays her a specific sum of money other than the mahr is forbidden for her. It is obligatory to cooperate and advise one another to abandon this custom and to be content with what the pure Shari'ah has prescribed regarding the known mahr. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
