The first question of Fatwa No. ( 9535 )
Q1: Indeed,a man married a girl who was eleven years old, and he paid one-third of the mahr, with two-thirds remaining, and she passed away before he consummated the marriage, and she had not yet reached the age of fifteen,I ask you to inform me whether the girl's guardian is obligated to pay the amount that was given, or what he should do? May Allah reward you with the best reward.
A1: If the facts are as stated, the entire specified mahr is obligatory, and her heirs inherit it from her according to the rules of the Shari'ah. Among her heirs is her husband. This is after settling any debts she owed and executing her bequest, if she left one.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
