Fatwa No. ( 13024 )
Q: Allah has decreed—and there is no turning back His decree—that my marital life should end after a journey that lasted ten years, which bore my daughter who is now nine years old. My ex-wife has requested to visit her daughter, and I replied: I have no objection, and it is her right to see her daughter, except that this must take place at her parents' home, who were the cause of what happened between me and my wife. Relying on what the jurists have stated regarding a mother visiting her daughter, because the need calls for it, and the daughter is more entitled to modesty and protection than her mother, because she is a young girl, and so on, as the scholars have issued rulings in such cases, which are not hidden from you. Previously, I had taken the daughter to the hospital for a procedure, and we contacted her mother to visit her daughter in the hospital, and this was before the separation, but she refused, casting aside all
considerations, and ignoring her duty toward her daughter as a mother. O Master of Generosity: I have relatives who are the object of my trust, and they are my brothers and sisters, and each of them lives in a separate house. Do you see, may your honor be respected, that it is possible for the mother to visit her daughter in one of those houses at a time when I am not present there, if she does not wish to visit her in my father’s house where I reside with my daughter? May Allah guide your honor to what is good.

A: There is no objection to her visiting her daughter in your father’s house where you reside, or in one of the houses of your brothers and sisters, because they are mahram (relatives one may not marry) to your daughter. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
