Q1: In some communities, especially in the southern regions, there is mixing of men and women without the prescribed covering, and sometimes seclusion occurs between a man and a woman who is not his mahram. When they are advised against this, they do not accept the advice; rather, they say, "Our hearts are pure." And when it is said to them, "This matter was commanded of the Companions, and their hearts are purer than yours," they do not take heed from this. They try to escape the argument with weak excuses. We ask for clarification of the ruling of the Shari'ah in this matter, who bears the responsibility regarding this matter, and whether it is obligatory for a woman to apply the hijab and refrain from mixing, even if her guardian or husband does not order her to do so. What do you advise in such a matter? And is it obligatory for a man to refrain from mixing with women who are not mahrams, and to refrain from seclusion with women who are not mahrams, even if his heart is clean as he claims?
A1: Exposing the 'awrah is forbidden, whether by a man or a woman. The mixing of men and women in a way that incites fitnah and serves as a means to corruption is
forbidden, and the seclusion of a woman with a non-mahram other than her husband is forbidden. Every mukallaf, male or female, must protect his or her honor and adhere to the Shari'ah of his or her Lord. The wali al-amr, both private and public, must restrain the foolish and punish those who transgress the Shari'ah of Allah, its limits, and its etiquettes. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
