Q: A man, his wife, and their four children—three boys and one girl—died as a result of a car accident. Since death overtook them suddenly, it is not known which of these deceased died first and which died later; rather, they died at the scene of the accident, in the same hour, and no living soul was seen among them. The man’s inheritance is restricted to his two parents: his mother and his father only. The wife’s inheritance is restricted to her two parents: her mother and her father only. They were awarded blood money at a rate of sixteen thousand for the male and eight thousand for the female. One matter remains: the blood money for the four children, three males and one female, for which they were awarded fifty-six thousand riyals. Since I am the legal guardian for all of them to distribute the inheritance to its rightful recipients according to the Shari'ah, and I wish to give every right its due, I ask you to issue a ruling on the following: 1 - Does the children’s paternal grandmother have a right in their blood money alongside their paternal grandfather?
And what would her share be? 2 - Does the children’s maternal grandmother have a right in their blood money alongside their paternal grandmother, and what would her share be?
A: Since the questioner stated that the man died leaving behind his mother and father, that the wife died leaving behind her mother and father, and that each of the four children died leaving behind their paternal grandfather, paternal grandmother, and maternal grandmother, and that all of them died as a result of a car accident, and that it is not known who died first among them, if that is the case, then those who died do not inherit from one another; because one of the conditions of inheritance is the confirmation of the heir’s life after the death of the deceased, and this condition is absent here.
