Q1: A soldier from among the soldiers in Mina entered the state of ihram on the eighth day, and performed tawaf and sa'y that day. On the ninth day, he ascended to 'Arafah at twelve o'clock, and descended from it before four o'clock that day to the tents of his brothers in Wadi Muhassar , and sat with them until the tenth day, and he stoned the pillars and shaved his head. Is his Hajj valid or deficient? Please inform us, may Allah reward you with good.
A1: His entering the state of ihram on the eighth day is valid, and the tawaf and sa'y he performed are not prescribed for him, nor do they suffice for the tawaf and sa'y of Hajj; because he entered the state of ihram from within the sacred precinct. His ascent to 'Arafah on the ninth day at twelve o'clock carries no obligation upon him, but his descent from 'Arafah before four o'clock that day is not permissible. It is obligatory for him to remain in 'Arafah until the sun sets, and by descending before sunset, he left an obligatory act, for which he must sacrifice an animal, which is what suffices as an 'Id sacrifice from sheep, goats, or a seventh of a camel
or a seventh of a cow, to be slaughtered in the sacred precinct and the meat distributed to the poor of the sacred precinct. And since he descended from 'Arafah before four o'clock on the day of 'Arafah to the tents of his brothers in Wadi Muhassar and sat with them, this indicates that he left the overnight stay at Muzdalifah . If that is the case, he has left an obligatory act of Hajj, and he must slaughter an animal that suffices as an 'Id sacrifice from sheep, goats, a seventh of a camel, or a seventh of a cow, to be slaughtered in the sacred precinct and distributed to the poor of the sacred precinct. His stoning on the day of 'Id is valid, as is his shaving. The answer did not address the remaining acts of Hajj because the questioner did not ask about them. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
