Q: I went with my family to Hajj when I was sixteen or seventeen years old, and I had not yet married. At the miqat, we entered the state of ihram for Hajj alone (ifrad), we performed the arrival tawaf around the Ka'bah, and we performed the sa'y of Hajj. On the ninth day of Dhul-Hijjah, we went with the pilgrims to 'Arafah, and we stayed outside of 'Arafah until we prayed the Dhuhr prayer. Then my family went to 'Arafah and my father ordered me to stay by the car and the luggage outside of 'Arafah. The preachers and guides came to us with loudspeakers, calling out to the pilgrims: "Enter 'Arafah, you are outside of 'Arafah." However, at sunset, and during this time, I masturbated with my hand until I ejaculated. At sunset, my family came to me and we left with the people to Muzdalifah, then to Mina, and my father stoned the pillars on my behalf. I did not perform the tawaf of ifadhah, nor the farewell tawaf. We shortened the ends of our hair and we went to our country after staying in Mina for two nights with my father, who also stoned the pillars on the days of Tashriq. Three years after this Hajj, I got married, then I performed 'Umrah after the marriage and I performed Hajj. The question: 1- Is my Hajj valid or not? 2- Is the marriage contract valid or not? 3- Are the 'Umrahs and the two Hajjs valid or not? I ask you to issue a detailed fatwa for me, and may Allah preserve you.
A: You missed the Hajj in that year, and the 'Umrah you performed afterward is considered the exit from the state of ihram you were in from that Hajj in which you missed the Hajj. The Hajj you performed afterward is considered making up for that missed Hajj, but you are required to do three things: The first thing: Renew the marriage contract; because you contracted it while you were in the state of ihram for the Hajj that you missed. The second thing: You must slaughter a fidyah that is acceptable for the 'Id sacrifice, slaughter it in Makkah, and distribute it to the poor of the Haram. If you are unable to do so, then you must fast for ten days. The third thing: You are required to slaughter a sheep in Makkah for the masturbation you committed while in the state of ihram, and distribute it to the poor of the Haram. If you are unable to do so, you must fast for ten days.
