The first question of Fatwa No. ( 501 )
Q1: Is it permissible to ston the pillars on behalf of women during Hajj in our time, given the severe crowding?
A1: Allah the Exalted said:
Allah intends for you ease and does not intend for you hardshipيُرِيدُ اللَّهُ بِكُمُ الْيُسْرَ وَلاَ يُرِيدُ بِكُمُ الْعُسْرَ
[Al-Baqarah 2:185]
, and He the Exalted said:
Allah does not intend to make difficulty for youمَا يُرِيدُ اللَّهُ لِيَجْعَلَ عَلَيْكُمْ مِنْ حَرَجٍ
[Al-Ma'idah 5:6]
, so hardship and difficulty are negated in this Shari'ah by these two verses and what came in their meaning. Women differ in their conditions: among them are the pregnant woman, the very large-bodied woman, the emaciated woman, the sick woman, and the elderly woman who is unable, and among them is the strong woman. As for the woman who has an excuse from the excuses mentioned or similar to them,
it is permissible for someone to act on her behalf, and there is no doubt in that. The one who stons on her behalf does not act on her behalf except with her permission before stoning on her behalf; he stons for himself and then for her. As for the strong woman, if an unusual hardship occurs, it is permissible to act on her behalf in the manner previously described regarding how to act on behalf, namely that he stons for her after he has stoned for himself. The person who acts as a deputy in stoning on behalf of another must be one of the pilgrims. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
