The first question of Fatwa No. ( 16745 )
Q1: My brother passed away, leaving behind eleven children and a debt of 118,000 riyals. He left nothing but a salary of 800 riyals. Additionally, they have been receiving an annual social security benefit starting from 10/3/1414 AH, amounting to (1600). Do I have the right to pay some of the creditors from this insurance, or not, even though the children are living in a rented house and I am supporting them from my own salary?
A1: The insurance paid to the orphans by the state must be preserved for them, and you must spend on them from it, as well as from the pension. It is not permissible for you to pay the debt owed by their father from it unless they reach the age of maturity and permit it. If you pay your brother's debt from your own wealth, you are doing a good deed, and you will have a reward for it. Or you may mention it to some generous people, perhaps they will pay it off, and you will be a means of good. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
