The first question of Fatwa number ( 11469 )
Q1: What is the ruling on my sister’s bequest to me to perform Hajj on her behalf? Is it obligatory for me to perform Hajj on her behalf before performing it on behalf of my mother, and then on behalf of my father, if Allah wills for me to fulfill this intention? Or does the bequest transfer to my sister’s son, who is currently in the Kingdom , so that each of us performs Hajj on behalf of his or her mother?
A1: It is permissible for a person, if he has performed Hajj for himself, to perform Hajj on behalf of his mother and then on behalf of his father. As for your sister, her son should perform Hajj on her behalf after he has performed it for himself. If her son refuses to perform Hajj for her and she desires that it be performed on her behalf, it is permissible for you to do so. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
