Q: The mosque of Hiltahim is old, and it has been decided to demolish it and rebuild it anew from the donations of benefactors. Some of the neighbors of the mosque also donated their houses to be added to the mosque, but these houses, even in total, are not sufficient to serve as a house for the imam and another for the mu'adhdhin. What is the ruling on allocating a portion of the mosque to build two houses: one for the imam and the other for the mu'adhdhin?
A: It is not permissible to allocate a portion of the mosque to build a house for the imam or the mu'adhdhin or for both; because the land of the mosque was made an endowment for prayer therein, so it is not permissible to divert it to anything else except for a valid reason, and the need of the imam or the mu'adhdhin for housing is not among the things that permit that. It is incumbent upon the specialized bodies and the wealthy people—especially the residents of the mosque's neighborhood—to cooperate in finding a house
for the imam and the mu'adhdhin near the mosque if the need arises for that; to facilitate their performance of the duties of leading the prayer and calling to prayer. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
