Praise be to Allah, and may peace and blessings be upon the one after whom there is no prophet. And after: The Permanent Committee for Scholarly Research and Ifta has reviewed
what was sent to His Eminence the General President from the questioner: the Director of the Branch of the Ministry of Islamic Affairs, Endowments, and Guidance in the Riyadh region, and referred to the Committee by the General Secretariat of the Council of Senior Scholars with number (784) and date 25 \ 3 \ 1418 AH. The questioner asked a question, the text of which is as follows: It is not hidden from Your Eminence that the people of the Al-Uqayq neighborhood north of the city of Riyadh have requested from the Municipality of the city of Riyadh to give them a site for a mosque and a residence for the imam and the mu'adhdhin, from the public land according to the attached sketch. The Municipality fulfilled their request and relinquished an area of four thousand and two hundred and fifty meters. A person of good will has come forward wishing to build the mosque and the residence for the imam and the mu'adhdhin. Since the mosque land is very large, the person of good will requested that we relinquish to him an area of one thousand and five hundred meters (30 × 50 = 1500m), in exchange for building the mosque and the residence for the imam and the mu'adhdhin, as the person of good will intends in the future to utilize the aforementioned area for breaking the fasts of those fasting, teaching the Qur'an, and maintaining the mosque; therefore, we request your fatwa on this matter. May Allah prolong Your Eminence's life and grant you abundant reward and recompense.

After the Committee studied the inquiry, it answered that it is obligatory to allocate
the entire area for building the mosque and its buildings and facilities upon it, and it is not permissible to carve out any part of it for another purpose; because once it was allocated for the mosque and its facilities, it became exclusive to it. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and companions.
