The third question of the fatwa numbered ( 9422 )
Q3: If a Muslim is poor and lives in a non-Muslim country, and he has no one to help him financially with a loan, and he is compelled to borrow a sum from the bank, paying an extra amount as riba, is it permissible for him to pay the extra amount as riba to the bank, given that his poor condition compels him to do so?
A3: He has no excuse to meet his needs through riba. It is obligatory for him to seek another permissible means, or to move to the lands of the Muslims if that is feasible; so that he can cooperate with them in righteousness and piety, protect his religion from trials, and obtain what meets his needs in terms of wealth and knowledge. And Allah the Exalted said:
And whoever fears Allah - He will make for him a way out (3) And will provide for him from where he does not expect.وَمَنْ يَتَّقِ اللَّهَ يَجْعَلْ لَهُ مَخْرَجًا (2) وَيَرْزُقْهُ مِنْ حَيْثُ لاَ يَحْتَسِبُ
[At-Talaq 65:2-3]
, and He the Exalted said:
And whoever fears Allah - He will make for him of his matter ease.وَمَنْ يَتَّقِ اللَّهَ يَجْعَلْ لَهُ مِنْ أَمْرِهِ يُسْرًا
[At-Talaq 65:4]
