The dispensation for breaking the fast in Ramadan for a sheep herder

Q:A man fasted Ramadan and broke his fast for half the month, 15 days, and his excuse was that he was herding sheep for a wage.He had asked a man who claimed to be a student of knowledge, and he issued a ruling to him saying, "Give charity for each day in the amount of a quarter of a dinar." The mufti cited the noble verse as evidence:
And upon those who are able [to fast, but with hardship] - a ransom [as substitute] of feeding a poor personوَعَلَى الَّذِينَ يُطِيقُونَهُ فِدْيَةٌ طَعَامُ مِسْكِينٍ
[Al-Baqarah 2:184]
And I am present to ask about the aforementioned answer.

A: First: It is not permissible for one who herds sheep to break his fast except in a state of dire necessity. If he is compelled, he should consume what removes the compulsion, then abstain for the rest of his day, and then make up the days he broke. Second: The answer given by the one asked, that he should give charity for every day in the amount of a quarter of a dinar, is not correct. Rather, it is obligatory for him to make up the fasts, based on the saying of Allah the Exalted:
(183) O you who have believed, decreed upon you is fasting as it was decreed upon those before you that you may become righteous - (184) [Fasting for] a limited number of days. So whoever among you is ill or on a journey [during them] - then an equal number of days [are to be made up]. And upon those who are able [to fast, but with hardship] - a ransom [as substitute] of feeding a poor person [each day]. And whoever volunteers excess - it is better for him. But to fast is best for you, if you only knew. (185) The month of Ramadhan [is that] in which was revealed the Qur'an, a guidance for the people and clear proofs of guidance and criterion. So whoever sights [the new moon of] the month, let him fast itيَا أَيُّهَا الَّذِينَ آمَنُوا كُتِبَ عَلَيْكُمُ الصِّيَامُ كَمَا كُتِبَ عَلَى الَّذِينَ مِنْ قَبْلِكُمْ لَعَلَّكُمْ تَتَّقُونَ (183) أَيَّامًا مَعْدُودَاتٍ فَمَنْ كَانَ مِنْكُمْ مَرِيضًا أَوْ عَلَى سَفَرٍ فَعِدَّةٌ مِنْ أَيَّامٍ أُخَرَ وَعَلَى الَّذِينَ يُطِيقُونَهُ فِدْيَةٌ طَعَامُ مِسْكِينٍ فَمَنْ تَطَوَّعَ خَيْرًا فَهُوَ خَيْرٌ لَهُ وَأَنْ تَصُومُوا خَيْرٌ لَكُمْ إِنْ كُنْتُمْ تَعْلَمُونَ (184) شَهْرُ رَمَضَانَ الَّذِي أُنْـزِلَ فِيهِ الْقُرْآنُ هُدًى لِلنَّاسِ وَبَيِّنَاتٍ مِنَ الْهُدَى وَالْفُرْقَانِ فَمَنْ شَهِدَ مِنْكُمُ الشَّهْرَ فَلْيَصُمْهُ
[Al-Baqarah 2:183-185]

He saidIbn Jarir(may Allah have mercy on him), after mentioning a group of opinions in the interpretation of the saying of Allah the Exalted:
And upon those who are able [to fast, but with hardship] - a ransom [as substitute] of feeding a poor personوَعَلَى الَّذِينَ يُطِيقُونَهُ فِدْيَةٌ طَعَامُ مِسْكِينٍ
[Al-Baqarah 2:184]
He said, "The most appropriate of these opinions for interpreting the verse is the opinion of the one who said:
And upon those who are able [to fast, but with hardship] - a ransom [as substitute] of feeding a poor personوَعَلَى الَّذِينَ يُطِيقُونَهُ فِدْيَةٌ طَعَامُ مِسْكِينٍ
[Al-Baqarah 2:184]
It is abrogated by the saying of Allah the Exalted:
So whoever sights [the new moon of] the month, let him fast itفَمَنْ شَهِدَ مِنْكُمُ الشَّهْرَ فَلْيَصُمْهُ
[Al-Baqarah 2:185]
Because the "ha" in His saying:
And upon those who are ableوَعَلَى الَّذِينَ يُطِيقُونَهُ
[Al-Baqarah 2:184]
This is in addition to the reports that support this view, which we mentioned earlier regardingMu'adh ibn Jabaland Ibn 'Umarand Salmah ibn al-Akwa'that after the revelation of this verse during the time of the Messenger of Allah (peace and blessings be upon him), they had the choice in fasting the month of Ramadan between fasting, in which case the ransom was dropped from them, and breaking the fast, in which case they redeemed it by feeding a poor person for each day. And they used to do this until the following was revealed:
So whoever sights [the new moon of] the month, let him fast itفَمَنْ شَهِدَ مِنْكُمُ الشَّهْرَ فَلْيَصُمْهُ
[Al-Baqarah 2:185]
so they were obligated
the obligation of its fasting, and the choice and the ransom became invalid. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
