The Shaykh : Yes, this percentage is valid. That is, it is permissible for a man who has agricultural land to give it to a farmer to plant it, and they agree on a specific percentage, such as twenty-five percent, which is a quarter, or fifty percent, which is half, or eighty percent, which is known. However, it is not valid for him to say, "Take this land and plant it; the eastern side is for me and the western side is for you," or to say, "Take this land and plant it; the wheat is for me and the barley is for you," or to say, "Take this land and plant it; the planting is for you one year and for me the next year." In these three cases, the contract of sharecropping is not lawful.
As for when the percentage is known by a shared portion, then there is nothing wrong with it. It is established from the Prophet (peace and blessings be upon him) that he contracted with the people of Khaybar for half of what comes out of it from fruit or crops. Yes.
