The second question of Fatwa No. ( 19765 )
Q3: A man asked another man to buy his farm, and the other said: I will sell it to you on the condition that the price is higher than what you are asking for. What is the ruling on that? Please inform us, may Allah reward you. An example: Muhammad owns a farm and asked Mahmoud to sell it for fifty thousand, so Mahmoud said: If I sell it for fifty-five thousand, are the five thousand for me? What is the ruling?
A2: If someone appointed you as his agent to sell a commodity of his, and he set a price for you to sell it at, then
if you sold it at a price higher than what he set for you, it is the right of the owner of the commodity, unless he is pleased with that for you and permits you to take it, in which case it is permissible for you to possess it in this case, and it is lawful for you. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
