Q: A woman from Yemen bequeathed to her heirs before her death that they appoint someone to perform Hajj on her behalf from her personal funds. There are Yemeni expatriates here in the Kingdom of Saudi Arabia and in the city of Jeddah whom they trust to perform this obligation. Is it permissible for those in the city of Jeddah to perform Hajj on behalf of this woman? Does the person enter the state of ihram from his home in Jeddah , or does he go to the miqat of the people of Yemen on the coast and enter ihram from there, or is it obligatory for the one who will perform Hajj on behalf of this woman to be from Yemen ; that is, his departure for Hajj is from Yemen ? And is it obligatory for this pilgrim to be from the town of this woman, the owner of the bequest?
A : The person who performs Hajj on behalf of the aforementioned woman does so from the location of the proxy if it is before the miqat. However, if it is beyond the miqat, he enters ihram from the miqat of his own country, unless he comes to Makkah from another route, in which case he must enter ihram from the miqat
