Fatwa No. ( 5533 )
Q: I am a man of ample means, and I have a sister whose husband is in financial distress. He had an accident and became indebted, unable to repay the debt because his family is very large, and he is the sole provider for his family. I have performed the obligatory Hajj and have performed it a second time. Now I want to perform Hajj for the third time and take my sister with me at my own expense, because she is unable to perform the obligatory Hajj. What is better in the sight of Allah the Exalted: that I take my sister with me, or that I relieve her husband’s distress by paying the costs of Hajj and its expenses? Please advise us, may Allah reward you with good.
A: If the situation is as you described, that your sister’s husband is burdened with debts and has no means to repay them, then it is better that you pay off his debts with what you have, and postpone taking your sister for Hajj. This is because paying off her husband’s debt and relieving the distress of both of them is more important than taking her for Hajj, and more beneficial for both of them. She is not obligated to perform Hajj until she is able to do so. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
