The third question of Fatwa No. ( 4763 )
Q3: What is your view regarding fasting six days after Ramadan in the month of Shawwal, as it appeared in the Muwatta of Malik : that the Imam Malik ibn Anas said regarding fasting six days after the breaking of the fast in Ramadan: that he did not see anyone from the people of
knowledge and jurisprudence fasting them, and that this was not reported to him from anyone of the predecessors, and that the people of knowledge dislike it, fearing its innovation, and that what is not part of Ramadan be attached to it. This statement is in the Muwatta, number 228, Part One.
A3: It is established from Abu Ayyub (may Allah be pleased with him) that the Messenger of Allah (peace and blessings be upon him) said:Jami` at-Tirmidhi 759Sahih (Darussalam) It was narrated by Ahmad and Muslim and Abu Dawud and al-Tirmidhi , so this is an authentic hadith indicating that fasting six days of Shawwal is a recommended practice (sunnah), and it was acted upon by al-Shafi'i and Ahmad and a group of the imams among the scholars, and it is not valid to counter this hadith with the reasoning some scholars give for disliking the fasting of these days, out of fear that the ignorant person may believe they are part of Ramadan, or out of fear that it may be thought to be obligatory, or because it was not reported to him from anyone of the people of knowledge who preceded him that he used to fast them, for these are mere suspicions, and they do not counter the authentic Sunnah, and the one who knows is a proof against the one who does not know.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and companions.
