Permission of the Parents in Jihad

Machine translationRead the Arabic original
The first question of Fatwa No. ( 2461 )
Q1: I would like to inquire about jihad in the cause of Allah. I am the eldest of my brothers, my father has passed away, and my mother is alive. I have a wife and children. I asked my mother for her permission to go to jihad, but she refused. Do I have permission to go to jihad?
A1: Jihad is among the best of deeds, and so is dutifulness to parents. If a person wants to go to legitimate jihad, he must seek their permission. If
He should be given permission; otherwise, he should not go to jihad. Rather, he must stay with them, for staying with them, or with one of them, is a type of jihad. The basis for this is what was narrated by Ibn Mas'ud (may Allah be pleased with him), who said:
I asked the Messenger of Allah (peace and blessings be upon him): "Which deed is most beloved to Allah?" He said: "Prayer at its appointed time." I said: "Then what?" He said: "Dutifulness to parents." I said: "Then what?" He said: "Jihad in the cause of Allah." The Messenger of Allah (peace and blessings be upon him) informed me of these, and if I had asked him for more, he would have given me more.
It is agreed upon. And from 'Abdullah ibn 'Amr (may Allah be pleased with them both), who said:
A man came to the Prophet (ﷺ) asking his permission to take part in Jihad. The Prophet (ﷺ) asked him, "Are your parents alive?" He replied in the affirmative. The Prophet (ﷺ) said to him, "Then exert yourself in their service."
Sahih al-Bukhari 3004
It was narrated by al-Bukhari , al-Nasa'i , Abu Dawud , and al-Tirmidhi , and he graded it as authentic. In another narration:
A man came and said: "O Messenger of Allah, I have come intending to go to jihad with you, and I have come while my parents are weeping." He said: "Go back to them and make them laugh as you have made them weep."
It was narrated by Ahmad and Abu Dawud and Ibn Majah . And from Abu Sa'id (may Allah be pleased with him),
A man emigrated to the Prophet (peace and blessings be upon him) from Yemen. He said: "Do you have anyone in Yemen?" He said: "My parents." He said: "Did they give you permission?" He said: "No." He said: "Go back to them and seek their permission. If they give you permission, then go to jihad; otherwise, be dutiful to them."
, it was narrated by Abu Dawud . And from Mu'awiyah ibn Jahimah al-Sulami ,
Jahimah came to the Prophet (peace and blessings be upon him) and said: "O Messenger of Allah, I intended to go on a military expedition and I came to you to seek your advice." He said: "Do you have a mother?" He said: "Yes." He said: "Stay with her, for Paradise is at her feet."
it was narrated by Ahmad and al-Nasa'i . All these evidences, and what comes in their meaning, apply to one for whom jihad is not an individual obligation.
If it becomes an individual obligation upon him, then abandoning it is a sin, and there is no obedience to a created being in disobedience to the Creator. Among the types of obligatory jihad is being present between the two lines of battle, or the imam calling for mobilization. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
